ORDER No. 52A

(Show Cause Why Cases Should Not be Dismissed/Administratively Closed)

In March 1999, the court entered Order 52, listing some 4,000+ cases and directing plaintiffs' counsel in those cases to file with the undersigned by May 14, 1999, a brief status report on each of the cases so listed. For the cases listed in the appendix to this Order 52A, the court still has not received status reports despite follow-up telephone calls to counsel.

The court is now ordering that, in the absence of a report by September 13. 1999 (or the obtaining of an extension for good cause shown), these cases will be dismissed/administratively closed on the terms set forth in paragraph 6.

Counsel for plaintiffs should send to the undersigned in writing by September 13, 1999, a brief status report for each of the cases listed in the appendix to this order. Cases are listed in order of transferor court and case number.

1. The status reports should be mailed directly to the undersigned (Judge Sam C. Pointer, Jr.; Room 882; Federal Courthouse; Birmingham, Alabama, 35203) and should NOT be sent to the clerk of court for filing. (See paragraph 5 below for filing of stipulations, etc.)

(a) Mail to the undersigned only the original report, and NOT any additional "courtesy" copies. Do not ask for or expect any acknowledgment of receipt.

(b) If more than one attorney represents plaintiff(s) in a listed case, those attorneys should coordinate their status reports in an effort to eliminate, or at least reduce, potentially duplicative submissions of status reports involving the same case.

(c) A single, consolidated report should be submitted for each attorney (or affiliated attorneys), providing through an appendix in tabular/columnar format the requested information on all such cases (rather than by submitting separate status reports on each individual case).

2. A copy of the report should be sent to counsel for each defendant against whom some claim is indicated as subject to being pursued. See paragraph 3(e) below.

3. The report should, separately for each case (and, in multiple-plaintiff cases, separately for each individual plaintiff on whose behalf some claim is being pursued), repeat the identifying case information (i.e., the transferor court, the transferor case number, and the ALN case number as shown in the appendix) and then, in separate columns, indicate—

(a) any corrections in the identification of the attorney or party who should be shown as the "contact/liaison" person for receiving further notices on behalf of plaintiff(s).

The "namecode" shown in the appendix is an abbreviated code for one of the attorneys shown by this court as counsel of record for one or more of the plaintiffs in the case. This information, for the most part, was taken from data supplied to this court by transferor courts or the Judicial Panel on Multidistrict Litigation, and may be incorrect or outdated. This information may indicate the namecode of an attorney who has been allowed to withdraw where the court has not received information about a new counsel (or the mailing address of a plaintiff who should be shown as proceeding pro se). Please indicate in the status reports what changes should be made in identifying the person(s) currently representing the plaintiff(s) (or the mailing addresses of plaintiffs who should be shown as proceeding pro se).

(b) in multi-plaintiff cases, the name of the plaintiff with a claim that can and will be pursued.

(c) what action by this court is believed to be appropriate (e.g., remand to federal court; administrative closing, etc.).

(d) if a claim is identified in paragraph 3(e) below as one to be pursued against the Bristol, Baxter, 3M, or Union Carbide defendants, the approximate date when the plaintiff opted out of the original global settlement or Revised Settlement Program.

(e) the identification of any defendant(s) against whom the plaintiff can, and will, pursue a claim. Listing of these defendants in the status reports will be subject to the obligations of Fed. R. Civ. P. 11.

In identifying these "active defendants", plaintiffs' counsel are directed to take into account: (1) the previously-entered summary judgments in favor of a number of defendants, such as Corning, Inc., Scotfoam Corp, General Electric, Cabot Medical, etc.; (2) the prohibition against pursuing claims against the Bioplasty defendants based on bankruptcy proceedings; (3) the preclusion of claims against the Mentor defendants (except for implants implanted after May 31, 1993; (4) the preclusion of claims against Union Carbide (except by "opt-outs" to the extent based on its 1990-92 ownership of McGhan Nusil); (5) the preclusion of claims by "non opt-outs" against the Bristol, Baxter, and 3M defendants); (6) the fact that any claims against The Dow Chemical Company and Dow Holdings, Inc., are no longer pending in this court but have been severed and transferred to the United States District Court for the Eastern District of Michigan; (7) the current prohibition against pursuing claims against Dow Corning Corporation (or its former subsidiary, Dow Corning Wright) based on bankruptcy reorganization proceedings in the Eastern District of Michigan; (8) the prohibition against pursuing claims against the McGhan Medical, INAMED Corp., and CUI defendants under the INAMED settlement order; and (9) the fact that many defendants named in the pleadings (e.g., American Hospital Supply, American Heyer-Schulte, etc.) no longer exist as separate entities but have been merged into and subsumed by other existing defendants (e.g., Baxter Healthcare).

In identifying these "active defendants", plaintiffs' counsel should also consider, under Fed. R. Civ. P. 11, whether other defendants who may have been originally named as parties—such as Frank Gerow or the Estate of Frank Gerow—should continue to be shown as defendants against whom claims will be pursued.

Through a footnote, endnote, or other special notation, counsel should identify any unusual problem relating to the claim of any plaintiff in a case, such as a pending request for a "late opt out" determination or a controversy about a prior settlement.

4. The appendix has been prepared in a format that, unless there are special situations (such as a multi-plaintiff case), the applicable pages can simply be copied and the requested information printed on the copy, and returned with a simple cover letter.

5. The court recognizes that, before September 13, 1999, there may be total or pro tanto stipulations and agreed-orders for dismissals to be submitted with respect to one or more plaintiffs with respect to one or more of the defendants in some of the cases listed in the appendix. Any such stipulations or proposed orders should be filed with the Clerk of this Court, after which they will be transmitted in due course to the undersigned for review and potential signing. Any such stipulations or proposed order should be filed with the Clerk (and not mailed to the undersigned, whether as an original or as a "courtesy copy"), although a notation may be made in the status report indicating such action is in process. The Court requests that any such pro tanto stipulation or dismissal identify other defendants against whom claims remain (rather than generically stating that the dismissal affects only the claims against the settling defendants). NOTE HOWEVER THAT, IN VIEW OF PARAGRAPH 6 BELOW, SUCH SEPARATE SUBMISSIONS MAY BE UNNECESSARY AND SIMPLY CREATE ADDITIONAL ADMINISTRATIVE BURDENS ON THE COURT.

6. Absent cause to the contrary shown in the status reports by plaintiffs' counsel, the court will order, with provisions for each party to bear its own costs, that claims in these cases against Dow Corning and Dow Corning Wright will be administratively closed (subject to reopening on the same terms as provided in Order 44B), that claims in these cases against the Bristol, Baxter, 3M, and Union Carbide defendants (if not listed in the responses as active claims, together with an indication of the "opt out date") will be dismissed (subject to reopening if such defendants fail to pay obligations to the plaintiff under the RSP), that claims in these cases against the INAMED, McGhan Medical, and CUI defendants will be dismissed (subject to reopening should the INAMED settlement be vacated), and that claims against other defendants (if not listed in the responses as active defendants) will be dismissed. IN VIEW OF THESE EXPECTATIONS, THE COURT SUGGESTS TO COUNSEL THAT SEPARATE SUBMISSIONS OF STIPULATIONS AND PROPOSED ORDERS UNDER PARAGRAPH 5 MAY BE UNNECESSARY AND MAY MERELY CREATE ADDITIONAL ADMINISTRATIVE BURDENS ON THE COURT.
